Altos Hornos de México, S.A.B. de C.V. (AHMSA) extends to you the most cordial welcome to its web site at www.ahmsa.com (the “web site” or “internet portal”) and recommends that any person (hereinafter “user”) who uses, visits, accesses or registers at AHMSA’s portal reads these terms and conditions of use carefully, as they constitute a binding agreement between AHMSA, a Mexican company dedicated to the production of steel whose head office is in the City of Monclova, Coahuila, and the “user”, with the purpose of establishing the ground rules for the use of the web site. Therefore, the user is advised that on accessing, using, visiting or registering at the web site, he/she recognises and accepts that AHMSA is exempt from any responsibility, loss, damage or risk that may result, directly or indirectly, from the use of the web site, as well as recognising and accepting that any use of AHMSA’s web site is bound by the terms of the present agreement, even when periodically modified, as well as by any applicable legal dispositions. Finally, the user recognises and accepts that he/she will use only the materials and services contained in this web site (hereinafter “services”) for personal ends, and not for comercial or informative purposes, and will not modify any of the services contained in AHMSA’s web site.

AHMSA reserves the right to modify, revise or up-date these terms and conditions without prior notice, and so the user’s continued use of this site after the publication of any change is proof sufficient that he/she agrees to such change.

Property Rights

AHMSA declares that it is in possession of all the industrial property and intellectual rights, which are duly registered with the Mexican Institute of Industrial Property (IMPI – anacronym in Spanish) according to the Law of Industrial Property and its Regulations, as well as with other laws and/or applicable treaties to which Mexico is a signatory, and for such reason AHMSA is the sole owner of all the rights, titles and interests associated with the services it provides.

The information contained in AHMSA’s electronic page, including as the case may be the brands and commerical notices, are legally protected and contain reliable information of a privileged nature.

In view of the above, the user accepts that the contents, which includes but is not limited to, texts, data, software, music, sound, photographs, videos, graphics or any other material to which the user has access on using the web site, is protected by author rights, commercial brands and notices, service brands, patents, industrial secrets, data rights, publicity and privacy rights, and other rights and intellectual property laws. Unless expressly authorised, the user must not sell, hire out, modify, copy, publish again, electronically transfer or discharge, exhibit, divulge, transmit or distribute in any way whatsoever the contents of AHMSA’s web site. The user accepts that all information provided by AHMSA or by means of AHMSA is for informative purposes only and does not seek to offer profesional consultancy.

Guarantee and Responsibility Waiver

In the case of the products and services available for sale and published on AHMSA’s internet page, it is pertinent to clarify that such products and services are as they are described on the web page, and so the responsibility in their acquisition, together with the costs of disassembly, transportation and re-assembly, are the user’s.

In the case of international operations, Customs’ documentation, taxes and other cuotas, together with the costs of disassembly, transportation and re-assembly, are the responsibility of the user.

Altos Hornos de México (AHMSA) is not responsible for any damage caused by disassembly, transportation or re-assembly of equipment.

ANY PRODUCT PURCHASED THROUGH THE INTERNET PAGE IS SOLD BY AHMSA “AS IS”, WITHOUT GUARANTEE OF ANY KIND, EXPLICIT OR IMPLICIT, INCLUDING BUT NOT LIMITED TO COMMERCIAL GUARANTEES, GUARANTEES FOR SPECIAL PURPOSE USE, AND GUARANTEES AFFECTING THE RIGHTS OF THIRD PARTIES. Furthermore, AHMSA and its subsidiary companies, enunciatively and without limit, do not guarantee, and so will not be held responsible for any direct, secondary, indirect, punitive or any other damage that may be a consequence of: a) the inexactness of the information contained in the site page or any omissions in its contents; b) the interrupted or erratic functioning of the site, or any other defect of the same; c) the transmission of viruses or any other harmful component through its site or the server that houses the site and that may result in, for example, damage to information equipment, or loss of business, benefit, profit or data. Finally, the user binds him/herself to protect AHMSA from any complaint, claim, action or suit, including those for profesional fees and legal costs, related to the improper or unlawful use which the user makes of the information contained in this site or in third-party sites which the user has accessed through a link available in our site.

Correct Use of the Services

By virtue of the service and contents safety provided for the user as described in the privacy policies of the web site, the user binds him/herself to a proper use of the services and is the sole person responsible for actions or omissions that occur as a consequence of the use of the web site and/or its access-registration, including without limitation whatsoever the content of transmissions via or to AHMSA’s site, and for which reasons the user binds him/herself to the following “not do” conditions:

a) Use the site to send mails about articles, products or services for reasons of publicity or spam, to send chain mails, or any other message or transmission of a commercial, publicity, or spam nature.

b) Use the site to summarise, compile or disseminate information about other users or AHMSA’s confidential information, with the intention of carrying out actions contrary to good manners, morality or law, to the prejudice of AHMSA and its users, with the purpose of obtaining personal gain or that of third parties.

c) Create a false identity or a false email address, nor in any way whatsoever try to deceive others over the identity of the sender or the source of the message.

d) Transmit through the site material with a content that is illegal, harrassing, difamatory, abusive, threatening, prejudicial, vulgar, obscene, offensive, or in any way censurable.

e) Transmit any material that may infringe intellectual property rights or other rights of third parties, including without limitation commercial brands, commercial secrets, or author rights.

f) Transmit any material infected by a virus, nor anything related to any type of virus, nor any other prejudicial or harmful programme.

g) Interfere with or disturb the functioning of the social networks connected to AHMSA’s site, or infringe the norms, policies, rules, procedures, terms and conditions of said networks.

h) Obtain, or try to obtain, unauthorised access to AHMSA’s site, or to other accounts or computer systems connected to AHMSA’s site by means of illegal searching for passwords, or by any other means.

i) Use AHMSA’s site in any unethical way, or in any way contrary to good manners, morality, and the law.

j) Use AHMSA’s site to promote business in favor of any company or service in competition with AHMSA and/or its subsidiary companies.

Without incurring any responsibility whatsoever, AHMSA may deny, suspend, or disqualify, partially or totally, the service to a user who has knowledge of an infringement of any of the above conditions. The user will be notified of the situation by means of a prior warning pointing out the cause that gave rise to the service suspension or disqualification.

Jurisdiction and Applicable Legislation

For everything concerning the interpretation, execution and/or fulfillment of that stipulated in the present Agreement and any matter that may arise from it or be related to it, AHMSA and the user expressly submit to the jurisdiction of the competent tribunals in the City of Monclova, Coahuila, Mexico, renouncing any other competence which, by virtue of present or future domicile, or for any other circumstance, could be applicable. Additionally, the present agreement will apply to all applicable legislation throughout the length and breadth of the United Mexican States.
